Community advocates are requesting your participation in the Oct 8th City of Sunnyvale Council 7:00pm Meeting.
Butcher’s Corner is 4th on the agenda – Discussion and Possible Action on Adoption of Resolutions to Approve the Annexation. The staff recommends Council find the project is categorically exempt from CEQA and postpone the annexation.
Peery Park is 5th on the agenda – Discussion and Possible Action to Find an Exemption under the California Environmental Quality Act CEQA and Introduce an Ordinance Addressing Development Review Procedures for Projects within the Peery Park District during Preparation of the Peery Park Specific Plan.
The Staff recommends:
The City Council hereby determines that the action taken to create the Peery Park District is exempt from the California Environmental Quality Act (CEQA) (Guideline 15061(b)(3)) because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Applications for development permits received by the City which describe the intensity of development, location of improvements and relationship to surrounding properties will be subject to CEQA for evaluation of environmental impacts as described in the application.
Since both the Peery Park and Moffett Park Specific Plan are business and traffic generating, with both affecting each other, it is unclear to me how the City of Sunnyvale has determined Peery Park to be “certainly no possibility of significant effects” is critical. It is the objective of an EIR to make that determination.
